Terms of Service

These Terms of Service ("Terms") govern your use of mindforgekids.io and the MindForge Academy storefront at mindforgekids.io/academy (collectively, "the Site"). By using the Site or buying any product, you agree to these Terms. If you do not agree, do not use the Site.

Plain-English summary: the games are free with optional paid extras. The Academy sells digital printable PDFs for personal/single-family or single-classroom use. Don't resell our PDFs. We try hard but make no guarantees. Refunds: see the Refund Policy.

1. Eligibility

You must be at least 18 years old (or the age of legal majority where you live) to create an account, make a purchase, or accept these Terms. Children may use the free games under parental supervision; account creation and purchases must be performed by an adult.

Every paid item sold through MindForge Academy is a digital download (PDF or ZIP). Upon successful purchase, MindForgeKids.io grants you a personal, non-exclusive, non-transferable, perpetual license to:

All MindForge content, including curriculum, designs, illustrations, and trademarks, remains the property of MindForgeKids.io. The Academy products are educational supplements; they do not constitute accredited curriculum or replace any government-mandated schooling requirement.

4. Free Games and Family Pass

The free games on MindForgeKids.io are provided "as is" for educational entertainment. Some advanced features may require a paid Family Pass subscription. Subscription terms (price, billing cycle, cancellation) are presented at the point of purchase and are charged through Stripe. You may cancel a subscription at any time from your account; cancellations stop future charges and take effect at the end of the current billing period.

MINDFORGEKIDS.IO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL MEET YOUR REQUIREMENTS. EDUCATIONAL MATERIALS ARE A SUPPLEMENT, NOT A GUARANTEE OF EDUCATIONAL OUTCOMES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINDFORGEKIDS.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

You agree to indemnify and hold harmless MindForgeKids.io and its operators from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party right.

We may modify or discontinue features at any time. Where reasonably possible we will give notice of material changes that affect existing paid customers.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will change. Continued use of the Site after a change constitutes acceptance.

13. Termination

We may suspend or terminate your access to the Site or any account at our discretion for violation of these Terms. The license to digital products you have already purchased survives termination, subject to your continued compliance with Section 3.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of Ontario, unless mandatory consumer-protection laws in your jurisdiction provide otherwise.
